The fourth trial for Merck in its ongoing Vioxx litigation is set for a Texas state court on Jan. 24.The case was brought by the family of 71-year-old Leonel Garza, who had a history of heart problems and took Vioxx for one month prior to dying of a heart attack.The trial was scheduled for February 2005 but was rescheduled for court in Starr County, Texas, moving ahead of two other New Jersey cases.Merck lost the first Vioxx case in Texas State court in August, won the second case in New Jersey state court in the fall, and a federal trial in Houston ended in mistrial.
